Elizabeth Earned Sick Days


Elizabeth Earned Sick Time 


Here’s how it works:

All private sector workers in Elizabeth are eligible to earn one hour of sick time for every 30 hours worked.

  • Workers in establishments with 10 or more employees receive, job protected, paid sick time up to 40 hours a year (5 days).
  • Regardless of business size, direct service workers who are in contact with the public such as food-service workers and child or elder care workers are eligible to earn up to five days of paid sick time per year.
  • Workers in establishment with 9 or fewer employees receive, job protected, paid sick time up to 24 hours a year (3 days).

Allowable uses of earned sick days:

           ✔ Care for a worker’s own health needs including mental or physical illness, injury, health condition and preventative care.

           ✔ Care for family members such as a spouse, civil union partner, domestic partner, child, legal ward, sibling, parent, grandparent, and grandchild.

           ✔ Closure of the Employee's place of business by order of a public official due to a public health emergency or an Employee's need to care for a child whose  school or place of care has been closed by order of a public official due to a public health emergency.

Workers can begin earning sick time immediately, but the benefit is not available for use until 90 days after hire or implementation of this policy (Effective Date: July 2016).

Businesses already providing any type of job protected days off—paid time off, vacation, personal days, etc.—will be considered in compliance with the law as long as the leave can be used for sick day purposes and the same amount of time required by the law is given.

Employers have the right to require medical verification if a worker is absent for more than 3 days.
